Agreement and who may use it
These terms govern your use of Markyard, an application that helps print shops turn customer inquiries into quote-ready jobs. Markyard is provided by Dušan Milićević PR štamparija FOILIFY Valjevo, Dokmirska 4, 14000 Valjevo, Serbia ("we"). By creating an account or otherwise using Markyard, you agree to them on behalf of yourself and the business you use it for. Markyard is for business use by print shops and the people they authorise, not for personal or consumer use.
The service
Markyard reads customer inquiries from a Gmail mailbox you connect, extracts what is being asked for, checks it against products and prices you enter yourself, lets you check artwork, and prepares replies and quotes for you to review and send. It also keeps customers, jobs and tasks for your workspace. Markyard is still growing: features and the interface can change, and we will tell you before removing something you rely on.
Accounts and security
You are responsible for the accuracy of the information you give us, for keeping your login credentials confidential, for who you invite into your workspace and which role you give them, and for what happens under your account. Use two-step verification; a workspace owner can require it for everyone. Tell us immediately through the contact page if you believe your account has been accessed without authorisation.
Connecting Gmail
An owner or admin can connect one or more Gmail mailboxes to a workspace, either directly through Google's consent screen or with the optional Apps Script connector that runs in your own Google account. You may only connect a mailbox you are authorised to grant access to. What Markyard reads, stores and sends, and the limits on how it uses Google data, are set out in our Privacy Policy, and that description is part of these terms. You can disconnect a mailbox at any time in Settings, and revoke access from your Google Account.
Acceptable use
You may not use Markyard to:
- break the law, or produce content that does
- send spam or unsolicited bulk email; Markyard is for answering people who wrote to you
- interfere with the service, or try to reach another workspace's data
- reverse engineer, scrape or resell the service without our written permission
- upload artwork or content you do not have the right to use
- connect a mailbox in order to get around Google's or Gmail's own limits or policies
Your content and data
You own the data you put into Markyard or that reaches it from your mailbox: your catalogue, prices, customers, the inquiries in your mailbox, and the quotes and replies made from them. We do not claim ownership of it and use it only to provide the service to you, as described in our Privacy Policy. You can delete it, and ask us to export or delete all of it, as described below.
Processing your customers' data
Inquiries, customer records, quotes, jobs and files in your workspace contain personal data about your customers and other people. For that data your business is the controller, or a processor acting for its own controller, and we act as your processor. Our Data Processing Agreement (DPA) governs that processing. It forms part of these terms: you accept it when you create your workspace, and an owner of your workspace accepts any later version that changes your rights or obligations.
The DPA sets out, among other things, how we follow your instructions, keep the data confidential and secure, use sub-processors (each change announced at least 14 days in advance, with a right to object), help you answer your customers' requests, notify you of a personal data breach within 72 hours, return and delete the data, and allow audits. For customers in the European Economic Area it incorporates the European Commission's Standard Contractual Clauses for transfers to Serbia. Where these terms and the DPA conflict as regards that data, the DPA prevails.
AI output, approval and automatic replies
Extracted details, quotes and reply drafts that Markyard produces are suggestions. AI can be wrong, for example by misreading a quantity or a size, so check a draft before you approve it. Replies and quotes go out only after a person in your workspace approves them, and that requirement is checked by the database itself, not only by the screen you see.
The one exception is optional and off by default: an admin can turn on automatic replies for a mailbox, after confirming a warning. Markyard then sends short replies asking a customer for details their inquiry is missing, without a person approving each one, up to three per inquiry and 200 per workspace per day. Quotes are never sent automatically. Because you choose to approve, or to turn automatic replies on, you are responsible for what is sent from your mailbox, including its accuracy, pricing and tone.
Artwork
Artwork Check tells you what it can honestly say about a file: a vector file, or a clean high-resolution image, can be reproduced faithfully; a small, blurry or heavily compressed image cannot, and enlarging it does not recover detail that was never there. A version Markyard edits, for example by removing a background, is not the customer's original file. Check it yourself before it goes to press: a job printed from it is your responsibility.
Plans, trial and billing
Plans, prices and their limits are shown on our pricing page and in Settings → Billing before you subscribe. A new workspace starts with a 14-day free trial that needs no payment details. Paid plans are billed in advance, monthly, through PayPal, starting when the trial ends; PayPal's own terms apply to the payment. If the trial ends without a paid plan, or a payment fails, the workspace stops processing new mail and sending until a plan is active again; your data is kept.
A move to a higher plan takes effect and is charged straight away; a move to a lower plan takes effect at the end of the current billing period. You can cancel in Settings → Billing at any time, and your plan then stays active until the end of the period already paid. We will tell you before a price change applies to you. Nothing in these terms limits rights you have under mandatory law.
Third-party services
Markyard relies on services run by others, including Google (Gmail and the Gemini API), PayPal, Supabase and Vercel. Your use of Gmail and PayPal is also governed by your own agreements with them. We are not responsible for those services being unavailable, or for changes they make, but we will tell you if one affects how Markyard works for you.
Availability
We work to keep Markyard available, but do not guarantee any particular uptime. It can be unavailable for maintenance, a bug, or because Supabase, Vercel or Google is unavailable. Our status page shows the current state of each part of the product, and our Security page what is and is not in place yet.
Ending your use, export and deletion
You can stop using Markyard at any time. To close your account or workspace, or to get an export of your data first, ask through the contact page; we will confirm the request comes from an owner of the workspace, provide an export in a common machine-readable format if you ask for one, and delete the workspace and its data within 30 days, except billing records we must keep by law. See How to delete your data. We may suspend or close a workspace that seriously breaches these terms or that we reasonably believe is being used to break the law, and will tell you why unless the law prevents it.
Liability
To the extent the law allows, Markyard is not liable for indirect or consequential damages, lost profits, or a job printed from an extracted detail, a draft or an edited file that a person in your workspace approved without catching an error. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence, for injury to life, body or health, or under mandatory product liability or data protection law.
Governing law
These terms, and any dispute arising from them, are governed by the law of the Republic of Serbia, without its conflict-of-law rules and excluding the UN Convention on Contracts for the International Sale of Goods. The courts having jurisdiction for Valjevo, Serbia, decide any dispute, unless mandatory law gives another court jurisdiction. Data protection law that applies to you mandatorily, including the GDPR where you are in the European Economic Area, applies regardless of this choice.
Changes to these terms
We update the date at the top of this page whenever these terms change. If a change materially reduces your rights or changes what happens to your data, we tell you in the app or by email before it takes effect.
